VIOLENT VEG & VIVACIOUS VEG CAPTION COMPETITION (the “Competition”)
Competition Terms and Conditions (the “Terms”)
1. General
1.1 This Competition will run from 1st April 2012 (the “Start Date”) to 30th April 2012 (the “Closing Date”).
1.2 The Promoter of this Competition is Carte Blanche Greetings Limited, Unit 3 Chichester Business Park, Chichester, West Sussex, PO20 2FT (“CBG”).
1.3 CBG together with its agent Brandmaster Limited (Brandmaster) shall operate and adhere to the terms of this competition in accordance with these terms and any entry into the Competition shall be subject to the terms set out below.
2. To enter
2.1 Entries should be submitted on the prescribed entry form via the websites http://www.violentveg.com and http://www.vivaciousveg.com. Entries through agents or third parties will be invalid.
2.2 All entries for the Competition must be received no later than 12 midnight on the Closing Date to be eligible for selection.
2.3 No purchase is necessary to enter this Competition.
3. Eligibility
3.1 The Competition is open to all United Kingdom (excluding Northern Ireland) residents aged 18 or over as at the Start Date, excluding employees of CBG or any of their wholly owned subsidiaries or any marketing services agency, handling house or other company involved directly with the administration of this Competition, or any member of their households.
4. Validity
4.1 There is no limit to the number of entries per person.
4.2 CBG does not accept responsibility for lost, damaged or illegal entries.
4.3 Late, illegible or defaced entries will not be accepted.
5. To win
5.1 The judges will create a shortlist of entries which, in the judges’ opinion, have provided the most appropriate, witty and amusing caption. The winning entry will be drawn at random from this shortlist by CBG or its agents by 4th May 5.2 The panel of judges will be comprised of representatives of CBG and Brandmaster Limited. The Judges decision is final and no reasons or explanations will be provided and no correspondence will be entered into.
5.3 The winner will be notified by email or telephone or by relevant correspondence as soon as practicable after the draw has taken place and CBG will endeavour to provide the prize winners with confirmation that they have won a prize 7th May [this needs to be within a week of closing the competition]CGB will endeavour to dispatch all prizes within 7 days.
5.4 CBG’s decision regarding the determination of the winner and runners up will be final.
6. The prize
6.1 The winner picked will receive a framed print of the winning caption and artwork.
6.2 The prize is non-transferable. No cash alternative is available. In the unlikely event that a prize should become unavailable, CBG reserves the right to substitute a prize which it may determine as being of equal value.
7. Publicity
7.1 Details of all entries may be published on the websites http://www.violentveg.com and http://www.vivaciousveg.com. At the time of posting an entry onto the competition websites entrants will be given the option of displaying the entrant’s name and town together with the caption, or alternatively the entry may be posted as an anonymous entry.
7.2 Each entrant accepts that, if they win, CBG will have the right, without additional payment or permission, to use the winning entries, entrants’ name, age, and town of residence for the purposes of announcing the winners of this Competition (including, without limitation, announcement and publication on the websites http://www.violentveg.com and http://www.vivaciousveg.com) and for related promotional purposes and as required under Rule 9 below. Winners may be required to participate in post-event publicity.
8. Entries
8.1 All entries will become the property of Brandmaster on receipt and will not be returned. All copyright and associated intellectual property rights in any entries or associated works or materials that are posted by an entrant is hereby assigned to CBG or its agents absolutely.
8.2 Entries and information submitted by entrants must be the sole work product of the entrant. Each entrant herby warrants that his or her submission and all information which the entrant submits will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening. If relevant, CBG reserve the right, but not the obligation to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove any entry which breaches this clause.
8.3 By entering this competition you acknowledge that CBG and Brandmaster may use the content of your entry (including, without limitation, to license, publish, manufacture, and sell products and cards) and entrants hereby assign to Brandmaster all worldwide rights in their entries and waive all moral rights.
9. Winning entry details
9.1 The name of the winner will be sent to anyone who writes to CBG, requesting this information within 3 months after the Closing Date, enclosing a stamped addressed envelope, to CBG at the address in Rule 1 above, requesting details.
10. Data privacy
10.1 Personal information about prize winners will be shared with CBG’s agents to the extent necessary for prizes to be delivered to prize winners.
10.2 CBG would like to keep entrants informed of similar products and services available from CBG by email, post and/or telephone. However, if you specifically do not want to be contacted you will have an opportunity to opt out of receiving any information when posting your entry to the website(s) http://www.violentveg.com and http://www.vivaciousveg.com. If you do not opt out at this stage but subsequently decide that you no longer wish to receive this information please write to CBG at the address in Rule 1 (above) .
10.3 CBG will not pass your personal details to third parties for marketing or similar purposes.
10.4 All personal data relating to the Competition entrants will be used solely in accordance with current UK data protection legislation.
11. Rules
11.1 By submitting their entry, entrants will be deemed to have agreed to be bound by these Terms.
11.2 CBG cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition as a result of accepting any prize. Nothing shall exclude CBG’s liability for death or personal injury as a result of its negligence.
11.3 Events may occur that render the Competition itself or the awarding of the prizes impossible because of reasons beyond the control of CBG and accordingly CBG may at its absolute discretion vary, amend or withdraw the promotion and the entrant agrees that no liability shall attach to CBG as a result thereof.
11.4 Please retain a copy of these rules for your reference.
11.5 The Competition and Terms will be exclusively governed by English law and any disputes (including non-contractual disputes or claims) will be subject to the exclusive jurisdiction of the courts of England.
